Abstract
The present thesis critically examines the functioning of the criminal justice
newlinesystem in India with special reference to the offence of outraging the modesty of women
newlineunder Section 354 and Section 509 of the Indian Penal Code, focusing on the Allahabad
newlineregion of Uttar Pradesh. Despite constitutional guarantees and statutory protections,
newlinecrimes against women particularly those involving sexual harassment and assault
newlineremain alarmingly prevalent. This study seeks to bridge the gap between legislative
newlineintent and ground-level implementation by analyzing both official crime statistics and
newlinelived experiences.
newlineDrawing upon National Crime Records Bureau (NCRB) data from the past five
newlineyears, the research identifies trends, patterns, and regional disparities in the reporting,
newlineinvestigation, and prosecution of cases involving outraging modesty. The quantitative
newlineanalysis is complemented by primary data collected through structured Google Forms
newlinedistributed among women residing in urban and semi-urban areas of Allahabad. These
newlineresponses reveal critical insights into victims perceptions of police responsiveness,
newlineprocedural delays, societal stigma, and institutional support mechanisms.
newlineThe study employs a mixed-methods approach, integrating doctrinal analysis
newlinewith empirical findings to evaluate the efficacy of existing legal frameworks and
newlineprocedural safeguards. It also explores the intersectionality of gender, class, and locality
newlinein shaping access to justice. Through comparative references to adversarial and
newlineinquisitorial systems, the thesis proposes context-sensitive reforms aimed at enhancing
newlinevictim-centric justice delivery, improving police accountability, and fostering
newlinecommunity-based legal awareness.
